I’m a native son born in San Francisco California in 1943. My father was born in Spain and lawfully immigrated to the United States in 1930. My mother was first generation Basque and very proud of her peasant heritage. My three brothers, eldest sister and I were raised by our parents to believe in  God and in the Declaration of Independence of 1776; ‘ We, the People , hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that  among these are Life, Liberty and the pursuit of Happiness.’  Last month, I discovered while preparing a draft Amendment of the California Constitution, that in 1970,  our California Assembly quietly wrote and adopted the California Environmental Bill of Rights aka CEQA which in fact nullified our God given “Unalienable Rights”  of Life, Liberty and the pursuit of Happiness found in the Declaration of Independence. I was shocked with the realization that what our Lord had given all humanity, our California Assembly had taken away our unalienable rights without the People’s knowledge or approval. The People of California are treated as an “invasive species” and also as a plague on Mother Earth. Over the last forty years, the Progressives in the California Assembly have transformed our once Golden Republic into a 21st Century corrupt oligarchy (A system of government in which power is held by a small group). I have taken the liberty of authoring an expanded exclusive unalienable rights constitutional amendment for the purpose of fundamentally transforming our great state back to its pre-1970 Golden State status as experienced in governors’ Edmund (Pat) Brown and Ronald Reagan administrations.  

The Progressive Revolution in Politics and Political Science beginning in 1880 is the same Progressivism that has transformed 21st Century American politics. What is that transformation? It is a total rejection in theory, and a partial rejection in practice, of the principles and policies upon which America had been founded and on the basis of which the Civil War had been fought and won. While the current Progressive Royal Regimes differ in their assessment of the problems and how to resolve them, they generally share in common the view that government at every level must be actively involved in these reforms. Our existing constitutional system as crafted by our Founding Fathers is  thought outdated and must be made into a dynamic, evolving instrument of social change, aided by political scientific knowledge and the development of an ever expanding command and control  federal administrative bureaucracy.

Today, millions of Californians  experience the tyranny that our Founding Fathers feared and this threatens both the American Dream and the Constitutional liberties that assure the future of the dream. Thomas Jefferson feared the tyranny of those who fear and distrust the people, and wish to draw all from them into the hands of the higher classes. James Madison feared the tyranny of the majority and the abridgment of the freedom of the people by gradual and silent encroachments of those in power. John Adams feared all men, recognizing that “the only maxim of the free government ought to be to trust no man living with power to endanger the public liberty. ”  

Therefore, We the People of the Republic of California, have taken the first step in writing the text of the Water For Fighting ballot initiative that seeks to unshackle the long-suffering People of California from the bleak decades of thoroughly entangling regressive environmental and healthcare legislations , fraudulent IPCC global warming political science  hypotheses, countless bogus endangered species biological opinions, profuse restraining directives by inept unelected bureaucrats and the restrictive court decisions by disconnected jurists that have deprived Californians from their rightful and exclusive unalienable pursuits.

Initiative Language Presented to Attorney General Jerry Brown Requesting “Title & Summary”

(a) The State of California shall make no law prohibiting the free exercise of the People’s exclusive unalienable Right to Life; or abridging the freedom of the People’s exclusive unalienable Right to Life, Production, Use and Consumption of air, CO2, water, habitat for humanity, and energy generating natural resources.

(b) The State of California shall not levy any taxes, fees, assessments or fines on the Production, Use or Consumption by the People of air, CO2, water, habitat for humanity, and energy generating natural resources.

(c) The State of California, upon approval by the electorate, shall repeal the 1970 California Environmental Quality Act (CEQA),  the 1976 California Coastal Act  (Prop. 20), California Endangered Species Act (CESA) and the 2006 US California Global Warming Act (AB32), and expunge all references and all citations from the repealed laws found within the California Public Resource Code and Health and Safety Code.

(d) The People of California shall have the exclusive unalienable Right to nullify ALL Federal powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the State of California respectively, or to the People.
